Bill of Assurance

We, Kent E. Arnold, and Jeanne M. Arnold, his wife, being owners of the property hereinafter described, do hereby desire to place upon the following described real property located in Craighead County, Arkansas, to wit:

A part of lot 12 of the W. F. Hollingsworth Addition to the City of Jonesboro, Arkansas and a part of the Northeast Quarter of the Northwest Quarter (NEI/4, NW 1/4) of Section 24, Township 14 North, Range 3 Last of the 5th Principal Meridian in Craighead County, Arkansas, all being more particularly described as follows: From the Southwest corner of the NE 1/4, NW 1/4 of said Section 24, thence N89054'24"E 253.14 feet to a point on the easterly right of way of Hester Street, the Point of Beginning; Thence N01.25'35"E 685.40 feet to a point, thence N89.54'24"E 172.48 feet to a point, thence NO1.25'35"E 250.26 feet to a point on the southerly right of way of Christian Creek, thence southeasterly 110.89 feet along said right of way along a curve to the right, said curve having a central angle of 11.55'24" and a radius of 532.86 feet, thence S41 13'E 109.75 feet along said right of way to a point', thence southeasterly 174.86 feet along said right of way along a curve to the left, said curve having a central angle of 11.41' and a radius of 857.51 feet, thence S52.54'E 14.30 feet along said right of way to a point, thence south- easterly 124.12 feet along said right of way along a curve to the right, said curve having a central angle of 47'06' and a radius of 150.99 feet, thence S05.48'E 98.10 feet along said right of way to a point, thence in a southerly direction 135.77 feet along said right of way along a cu@ve to the right, said curve having a central angle of 08"30' and a radius of 915.15 feet-, thence S02'42'W 236.70 feet along said right of way to a point, thence southerly 74.79 feet along said right of way along a curve to the left, said curve having a central angle of 10.10'25" and a radius of 421.19 feet, to a point on the north line of a 30 foot tract of lafid dedicated as Cherry Avenue, thence S89.54'24"W 136.40 feet along the north right of way of Cherry Avenue to a point, continue thence along said right of way northwesterly 123.32 feet along a curve to the left, said curve having a central angle of 141.18'42" and a radius of 50.00 feet, thence S89.54'24"W 170.72 feet to a point, thence in a northwesterly direction 13.73 feet along a curve to the right said curve having a central angle of 44.57'09" and a radius of 17.50 feet, thence in a southwesterly direction 123.49 feet along a curve to the left, said curve having a central angle of 148.57'46" and a radius of 47.50 feet, thence S89.54'24"W 68.55 feet to the Point of Beginning, containing some 8.844 acres, more or less, thereof,

Certain restrictions and said property shall be held, owned and conveyed, subject to and in conformity with the covenants, subject only to amendment or cancellation as hereinafter provided. Said addition shall be known, designated and hereafter referred to as COUNTRY MEADOW COLLECTION.

  1. This property shall be used for residential purposes only and no structure or structures shall be erected or permitted on any part thereof other than one detached single family or condo dwelling not to exceed two stories in height, together with one attached or detached garage or carport (which may be used for storage, utility rooms, or other ordinary household or gardening purposes, but shall not be used as separate quarters for servants or employees).
  2. An accessory building may not be used for rental purposes.
  3. No home occupation or commercial activity of any kind or character shall be permitted on said property or any part thereof, except that small nurseries, gardens, personal services rendered entirely upon the premises and not in, conflict with applicable zoning laws shall be promotional activities for the same, and no signs on the premises advertising same.
  4. No sign of any kind shall be displayed to public view on said property, with the exception that a single sign shall be permitted of no more than five square feet in area advertising the property during the construction or sales period.
  5. No livestock of any description shall be kept on the property or any part thereof, except household pets and domestic animals which are not ordinarily kept for commercial purposes.
  6. The ground floor area of the main structure, exclusive of one story open porches and garages, shall be not less than 500 square feet of floor space in the case of a one-story structure, or less than 8UO square feet of floor space in the case of a one and a half or two story structure.
  7. No building shall be erected on said property. nearer than 25 feet to the front line and 10 feet from an adjoining building.
  8. An accessory building may occupy ten percent of the gross lot area, but must be built not less than 10 feet from any adjoining building and except for attached garages, must be built to rear of the principal building.
  9. Only one principal building shall be built on this property.
  10. Kent Arnold will retain architectural control of all exterior colors and materials. Washed pea gravel walks in front will be required.
  11. No chain link fence shall be placed upon this property without the consent in writing of the owners herein above named. All fences must be 6' high wooden. No fences except decorative fences shall come closer to the street than the front corners of the home.
  12. This property may not be subdivided.
  13. No trailer, basement, tent, shack, garage, barn or other temporary or permanent structure at any time erected on said property, other than the principal dwelling house, shall be used as a residence.
  14. No noxious or offensive activity shall be carried on upon said property nor shall anything be done thereon which may be or may become an annoyance or or nuisance to the neighborhood.
  15. No building shall be erected, placed or altered on this property until the building plans, specifications, exterior color scheme, and plot plan showing the location of such building with respect to existing topography and finished ground elevations have been approved in writing by the owners herein above named. In the event the owners fail to approve or disapprove any plans, specifi- cations, exterior color schemes or plot plans submitted to them as herein required within 30 days after such submission, this covenant shall be deemed to have been met fully.
  16. Any and all of the covenants, provisions, or restrictions set forth in this Bill of Assurance may be amended, modified, extended, changed or cancelled, in whole or in part, by a written agreement signed and acknowledged by the grantors herein (owners herein above named) and the then current owners of the property; and the provisions of such instrument so executed shall be binding from and after the date it is duly filed for record in the office of the Circuit Clerk in Jonesboro, Craighead County, Arkansas. The covenants, restrictions, and provisions as contained in this Bill of Assurance shall be deemed covenants running with the land and shall remain in full force and effect unless and until amended or cancelled as herein provided.
  17. In the event that any of the provisions of this Bill of Assurance shall be different from the requirements of any zoning ordinance now in effect or hereafter enacted, then this Bill of Assurance shall be considered to be ammended to conform to the requirements of such zoning ordinance where said requirements shall impose a greater limitation than is herein contained. However, if the provisions of this Bill of Assurance shall impose greater limitations than those contained in such zoning ordinance, then the provisions herein contained shall control.
  18. Invalidation of any restriction set forth herein or any part thereof by order, judgement or decree of any court or otherwise shall not invalidate or affect any of the other restrictions in whole or in part as set forth herein, said remaining restrictions to stay in full force and effect.
  19. These covenants shall be in full force and effect until January 1, 2029, subject to amendments, modifications, or cancellation as herein above provided.

We, Kent E. and Jeanne Arnold, his wife, for the purposes and considerations herein above contained and expressed, do hereby join in this Bill of Assurance for the purpose of relinquishing any right or possibility of dower and homestead which we may or might possess.
